High Court Judge in Pretoria, Hans Frabricius has ruled against SANDF in Collins Khoza’s case, who died after allegedly been assaulted by SANDF members in Alexandra for allegedly breaking lockdown regulations.
Judge Frabricius orders that all members of the SANDF who were present when the 40-year resident of Alexandra in Johannesburg, Collins Khoza was assaulted be suspended with pay pending an investigation.
“Within five days pending the outcome of disciplinary proceedings, place on precautionary suspension on full pay all members of the SANDF who were present at or adjacent to 3885 Moeketsi Street , Far East Bank, Alexandra, Johannesburg on 10 April 2020,” he said.
Judge Frabricius also orders that within two days, all members of SANDF, SAPS and any MPD should be commanded to adhere to to the absolute prohibition on torture and cruel inhumane or degrading treatment or punishment and to apply only the minimum force that is reasonable to enforce the law.
