Brown Mogotsi is expected back in the Johannesburg Magistrate’s Court on Tuesday for the continuation of his fourth bail application.
Mogotsi faces a charge of defeating the ends of justice linked to the allegation that he staged an attempted assassination in November 2025. He has not been convicted.
The latest bail proceedings were postponed last week so the Department of Correctional Services could provide a report on a new allegation that Mogotsi planned to escape from court holding cells.
The State says the allegation is contained in an affidavit from the investigating officer. Mogotsi’s defence was given an opportunity to respond.
His lawyers have presented two addresses as new facts supporting his release and have argued that he will return for trial. The prosecution has questioned why those addresses were not disclosed earlier.
The court must decide whether the information placed before it amounts to new facts and whether release would be in the interests of justice.
The escape allegation remains untested. It is not a finding by the court, and the Correctional Services report is expected to form part of Tuesday’s proceedings.
